I've been told that if I wait too long, I can no longer sue someone who injured me. Is that true?

Yes it is true, and here's a brief outline of the details. Think of food purchased at a supermarket. Each package has an "expiration date," and after that date passes, the food is considered to have passed its safe "shelf life" and it can no longer be sold. The same reasoning applies to lawsuits. Each type of claim that a person may want to sue over has a legal "shelf life" and a corresponding "expiration date." The reasoning is that after a certain amount of time passes, witnesses move away or die, memories fade, evidence gets lost, paper records get discarded and the case becomes too difficult to prosecute accurately. Therefore, laws called "Statutes of Limitation" (SOL's) set a shelf life for each type of case. After the expiration date, there is a nearly absolute bar against the right to sue. There are exceptions built into the law to extend the expiration date in certain situations, such as when a potential plaintiff is a minor, but this is not the place to go into detail. NY: Personal Injury: 3 years from the injury.

NY: Wrongful Death: 2 Years from the death.

NY: Medical Malpractice: 2 Years and 6 Months from the Malpractice.

MA: Personal Injury: 3 years from the injury.

MA: Wrongful Death: 3 Years from the death.

MA: Medical Malpractice: 3 years from discovery of the malpractice but no more than 7 years from the malpractice itself.
