I got hurt in a vehicle accident, but I've been told I can't always just sue the other driver. Is that right?

Sometimes you can sue right away, and other times you can't. Sound vague? I'll try to clear it up here in a short answer, and you can check my articles section for more detail. The short answer is that under "no-fault" insurance laws in New York and Massachusetts, the injury must be of a certain level of severity before you can sue the driver who hit you. If the injury does not reach that severity level, you must turn only to your own insurance company for coverage. The Massachusetts system is simpler, because as long as the injury generates at least $2,000.00 in damages (including medical costs and lost wages), you can claim against the other driver. Most emergency room visits with an X-ray will generate $2,000.00 in billing. In New York, there is a list of qualifying injury types that automatically allow you to claim against the other driver. The most obvious New York qualifying injuries (there are others) are death or a broken bone, and if you do not have such an injury, you may still be able to sue the other driver if your damages surpass $50,000.00.
