How much money can I expect to win if I sue over my injury?

There is no exact answer because each case is different. That being said, you can begin to get an idea of your claim's value by looking at a few factors. Your losses are known in legal terms as "damages." Damages come in two very broad categories: "Specific" and "non-specific."

Specific damages can be calculated exactly, such as lost wages over time, diminishment of earning capacity over time, medical billing, the costs of special equipment or rehabilitation services, and the like. Therefore, more serious injuries suffered by younger productive people tend to result in larger specific damages because they have a long work life and a long life expectancy before them.

Non-Specific damages refer to the amount that may be awarded for things like your pain and suffering. A jury might award you a million dollars for pain and suffering, but then again they might award you thirty nine dollars and ninety five cents. Nevertheless. even if the case settles before it gets to a jury, insurance companies consider the risks of large pain and suffering awards during negotiations.

Also, there are coverage issues to consider. Specifically, you might have a horrible injury and might have suffered terribly, but if the car that negligently hit you has a $25,000.00 insurance policy and its driver has no real assets, then the chances are good that $25,000.00 will be the ceiling. This unfortunate situation happens fairly often.
