The "Trustee" in a bankruptcy case ...who is that?

The Trustee in the bankruptcy case is essentially the lawyer for your creditors. His responsibility is to investigate your financial situation and the statements you have made about your situation in your "petition," which is the document you file to start a bankruptcy case. The Trustee is usually a private attorney that has been contracted by the Office of the United States Trustee to investigate, on behalf of your creditors, to either (a) make sure that you have no assets that he can seize and liquidate for your creditors, or (b) take charge of any unprotected assets that you may have and see to it that they are liquidated, with any resulting funds distributed to your creditors. In short, the Trustee is looking for money. He takes a nominal fee to "investigate" your situation at a hearing (please see my FAQ on "section 341" hearings), but he also takes a percentage of the value of any asset that is recovered for your creditors. In many cases, there are no assets for the Trustee to seize, and in such cases, the Trustee simply asks the court to close the case out and relieve him of his duties.
